OFFICIAL RULES AND REGULATIONS OF THE VISIT SOUTH OKANAGAN #myVSOKmemories PHOTO CONTEST
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
ELIGIBILITY
The Visit South Okanagan contest is open to residents of British Columbia, Canada.
No purchase is necessary to enter or win. Entry in this contest constitutes acceptance of the official rules and regulations as outlined below. Void where prohibited by law.
Employees, independent contractors, officers, and directors of Visit South Okanagan (VSOK) and its affiliates and subsidiaries and their immediate family members (spouse/domestic partner, parents, children, siblings and their respective spouses) and those living in the same household of each (whether legally related or not) are not eligible to enter or win.
ENTRY PERIOD
The contest will run during the following times:
April 7th – May 25th, 2021
After the completed contest period, the winner will be notified via direct message on social media (Facebook or Instagram), no more than 24 hours after the contest has ended.
HOW TO ENTER
1) Post your favourite memories to Instagram or Facebook, be sure to make your post public.
2) Instagram – Tag @visitsouthokanagan
3) Facebook – Tag @visitsouthokanaganBC
4) Use hashtag #myVSOKmemories (this is a requirement to be eligible for entry in competition)
5) Vintage throwbacks are highly encouraged!
6) Additional entries for following our Instagram and Facebook pages

Photos must be taken on or before December 31st, 2019, to be eligible for the contest.
PRIZE DETAILS
Please note the following restrictions for the prize:
Prize must be redeemed before they expire. Subject to availability. There will be no extensions for use of these beyond expiry date.
The total approximate retail value (“ARV”) for the Prize is in CDN Dollars as of date of printing of these Official Rules. The difference in value of Prize as stated herein and value at time of prize notification, if any, will not be awarded.
Prizes do not include any other item or expense not specifically described in these Official Rules & Regulations, including gratuities, and all additional expenses including, without limitation, other travel expenses, if any, are the sole responsibility of the winner. Only listed prizes will be awarded and no substitutions or cash equivalents or redemption will be made. The winner agrees to accept the prize “as is”, and entrants hereby acknowledges that Visit South Okanagan has neither made nor is in any manner responsible for liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. Prize travel is subject to space availability at time of booking and minimum reservations requirements may apply. Other conditions may apply.

SELECTION OF WINNER
One winner will be selected for each prize package. The winner of the prize packages will be selected randomly by Visit South Okanagan, whose decision on all matters relating to drawing and winner are final and binding. The Prize will be awarded at random from all eligible entries received. Visit South Okanagan reserves the right to disqualify any participant or winner and may refuse to award the prize to a person who is ineligible or has violated any rule, gained an unfair advantage in participating in the Contest or obtained winner status using fraudulent means. The odds of winning depend on the number of eligible entries received. The winner will be notified via email or social media account provided, no more than 24 hours after the contest draw date.
If the selected winner does not respond within 24 hours of notification, they will be disqualified, and another eligible entrant may be selected by random draw as a potential prize winner until such time as an entrant satisfies the terms set out herein and the prize is awarded.
Publicity, Privacy & Prize Notification
Except where prohibited by law or regulation, by submitting an entry, entrant grants Visit South Okanagan a perpetual, royalty-free license to use his/her name, submitted photography, video, voice, and likeness in connection with the promotion of this and other contests, and entrants waive any and all claims and/or rights to receive any royalties or other compensation for Visit South Okanagan’s use thereof, unless prohibited by law. Entrants’ information that Visit South Okanagan collects will not be disclosed to third parties.
Entrants that do not win will not be notified.
General Conditions
The submission of an entry is solely the responsibility of the entrant. Only eligible entries received within each Entry Period will be included in the prize drawings. Visit South Okanagan retains the right, in its absolute and sole discretion, to make substitutions of equivalent kind or approximate value in the event of the unavailability of any prize or component of the prize for any reason whatsoever.
This contest is subject to all federal, provincial and municipal laws. This contest and all affiliated businesses, entries, and entrants are not sponsored, endorsed or administered by, or associated with Facebook or Instagram.
Limitation to Liability & Release
By participating in the Visit South Okanagan photo contest entrants agree to indemnify and hold harmless Visit South Okanagan, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively “Releases”) from and against any and all injuries, losses, damages, claims, and actions of any kind arising from or relating to participation in the Contest, or acceptance, possession, use, misuse, or non-use of the prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages.
Submitted Photos
The photo must be original to the owner. By submitting a photo, participants can verify they hold all rights to the material.
Submissions must not violate any rights of a third party or copyright. Submissions must be free of violence, sex, slander, profanity, racism or any other offensive materials. Any submissions deemed offensive will be immediately disqualified.
Comments on Posts
Visit South Okanagan (VSOK) reserves the right to delete any posts or comments, for any reason. Entries cannot defame, misrepresent or contain disparaging remarks about Visit South Okanagan and its partners, or any of its products, or other people, products or companies or communicate messages or images inconsistent with Visit South Okanagan social media moderation policies or positive goodwill to which VSOK associates.
VSOK reserves the right to monitor and will monitor or screen entries and delete, if required in its sole discretion. By entering, you acknowledge that your entry may be posted on the VSOK’s social media, website or other media pages, in VSOK’s sole discretion. Visit South Okanagan has no obligation to use or post any photos or video that are submitted.
Rights and Ownership
By submitting photos through either personal Instagram feed, or through personal Facebook feed, as participation in the Visit South Okanagan #myVSOKmemories Photo Contest, you authorize the right to Visit South Okanagan to use the content on their official website (www.visitsouthokanagan.com ) and all social media platforms (including but not limited to: Facebook and Instagram). Through participating in this photo contest, you give the right to Visit South Okanagan, Destination BC and BC tourism partners to use your photo or video in marketing or branding content as they see fit.
Visit South Okanagan and all tourism partners shall have full right and power to copy, publish, broadcast, display, distribute, use, edit, translate, alter, combine with other content, reuse and adapt any or all portions of the entries in any way and for any purpose whatsoever, at any time, now or in the future, in any media now known or hereafter devised throughout the world in any manner whatsoever and for any purpose.
